Registered Mom: Baby Tracker is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is a personal tracking tool for informational and organizational purposes only.
Nothing in the App — including logs, summaries, trends, scorecards, or any other displayed information — constitutes medical advice or should be interpreted as a recommendation regarding the health, nutrition, development, or care of you or your child. The App is not a substitute for the advice, diagnosis, or treatment of a qualified healthcare professional.
Always consult your doctor, pediatrician, lactation consultant, or other qualified healthcare provider for any questions or concerns about your health or your child's health. Never disregard professional medical advice or delay seeking it because of something you have read or tracked in this App. In the event of a medical emergency, call 911 or your local emergency services immediately.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Registered Mom ("Developer," "we," "us," or "our") governing your access to and use of Registered Mom: Baby Tracker (the "App"), available on the Apple App Store for iPhone.
By downloading, installing, or using the App, you confirm that you:
- Have read and understood these Terms and our Privacy Policy,
- Are at least 18 years of age, and
- Agree to be bound by these Terms.
If you do not agree to these Terms, do not download or use the App. We reserve the right to update these Terms at any time; continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
2. App License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal license to download, install, and use the App on an Apple-branded iPhone device that you own or control, solely for your personal, non-commercial use.
This license does not permit you to:
- Copy, modify, adapt, translate, or create derivative works of the App or any part of it
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Sell, sublicense, rent, lease, lend, distribute, or otherwise transfer the App to any third party
- Remove, alter, or obscure any proprietary notices (including copyright, trademark, or patent notices) within the App
- Use the App for any commercial purpose or in any way not expressly permitted by these Terms
All rights not expressly granted to you are reserved by the Developer.
3. Apple App Store — Additional Terms
The App is made available through the Apple App Store. Your use of the App is also subject to Apple's Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms govern solely with respect to App Store delivery and payment.
Apple is not a party to these Terms. Apple has no obligation to provide maintenance or support for the App. In the event of any product liability, consumer protection, intellectual property, privacy, or other claims relating to the App, we — not Apple — are responsible. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
4. User Responsibilities
You are solely responsible for:
- Accuracy of data entered. The App is only as useful as the information you record. You are responsible for ensuring the data you enter is accurate and complete.
- Appropriate use. The App is intended as a supplemental personal tracking tool. It must not be used as a substitute for, or in place of, professional medical monitoring, diagnosis, treatment, or emergency care.
- Device security. You are responsible for maintaining the security and confidentiality of your device and restricting access to the App to authorized individuals.
- Backup of data. We are not responsible for any loss of data stored within the App. You are encouraged to maintain device backups through Apple's iCloud Backup or iTunes/Finder backup services.
- Compliance with applicable law. You agree to use the App only for lawful purposes and in a manner consistent with all applicable local, state, national, and international laws and regulations.
5. Health and Safety Disclaimer
Registered Mom: Baby Tracker is designed to assist parents and caregivers in organizing and tracking their baby's daily activity. The App's outputs — including logs, summaries, scorecards, patterns, and any other information — are based solely on data entered by the user and are provided for informational and organizational purposes only.
The App:
- Does not diagnose, treat, cure, or prevent any disease or health condition
- Does not constitute the practice of medicine, nursing, dietetics, or any other licensed health profession
- Does not replace the individualized judgment of a qualified healthcare professional who knows your or your child's full medical history
- Does not constitute a certified or regulated medical device under the laws of the United States or any other jurisdiction
Tracking data displayed in the App (such as feeding frequency, sleep duration, or diaper counts) is for personal reference only. Normal ranges vary widely among infants and are influenced by many factors. No information in the App should be used to make healthcare decisions without first consulting a qualified provider.
If you believe your child is experiencing a medical emergency, call 911 or your local emergency number immediately.
6. Intellectual Property
The App and all of its content, features, and functionality — including but not limited to the software, source code, design, graphics, logos, icons, text, and the overall "look and feel" of the App — are owned by Registered Mom and are protected by United States and international copyright, trademark, and other intellectual property laws.
The name "Registered Mom," the App name "Registered Mom: Baby Tracker," and all associated logos and marks are proprietary to Registered Mom. You may not use any of these marks without prior written permission.
Data you enter into the App (your tracking logs, notes, and records) remains your own. You grant us no license to use that data except as described in our Privacy Policy.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
- WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED BY OR THROUGH THE APP
- WARRANTIES THAT DEFECTS IN THE APP WILL BE CORRECTED
No advice or information, whether oral or written, obtained by you from us or through the App will create any warranty not expressly stated in these Terms.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REGISTERED MOM, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE
- LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, OR LOSS OF GOODWILL
- DAMAGES ARISING FROM YOUR USE OF, OR RELIANCE ON, ANY INFORMATION OR CONTENT DISPLAYED IN THE APP
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN
- DAMAGES ARISING FROM BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED TO OR THROUGH THE APP
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID, IF ANY, FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless Registered Mom and its affiliates, officers, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or reliance on the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any claim that your use of the App caused harm to you, your child, or a third party
10. Termination
These Terms remain in effect for as long as you use the App. We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice or liability.
You may terminate these Terms at any time by deleting the App from your device. Upon termination, the license granted to you will immediately cease, and you must stop all use of the App. Sections 5 (Health and Safety Disclaimer), 6 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) survive termination.
11. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to these Terms or the App shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas, and you hereby consent to personal jurisdiction and venue in such courts.
To the extent permitted by law, you waive any right to a jury trial for any dispute arising under these Terms.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. We may also notify you of changes through App Store release notes or within the App itself.
Your continued use of the App following the posting of revised Terms means you accept and agree to the changes. If you do not agree to the revised Terms, you must stop using the App.
13. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Registered Mom with respect to the App and supersede all prior agreements, representations, and understandings.
